⚖️ 1. Constitutional Position of the Governor

The Governor is the constitutional head of a State, appointed under Article 155 and holding office under Article 156. The office is modeled on the British constitutional system, where the head of the executive acts largely on advice.

Under Article 163, the Governor is required to act on the aid and advice of the Council of Ministers, except in limited discretionary situations. This reflects the principle that real executive power vests in elected representatives, not nominated authorities.

2. Constitutional Role of the State Legislative Assembly

The State Legislative Assembly represents the sovereign will of the people at the State level. It is directly elected and derives legitimacy from popular mandate.

  • Controls the Council of Ministers through collective responsibility
  • Passes laws and approves the State budget
  • Acts as the primary forum for democratic debate

 3. Democratic Philosophy Behind the Arrangement

The Constitution establishes a parliamentary democracy, where the executive is accountable to the legislature. The Governor is intended to be a neutral constitutional referee, not a parallel power center.

Any imbalance—where the Governor overrides the Assembly—undermines the spirit of representative democracy and federalism.
