1. Powers of the Governor
The Governor exercises executive power of the State in the name of the Constitution. However, these powers are largely formal and ceremonial in nature.
- Appointment of Chief Minister and Council of Ministers
- Summoning, proroguing, and dissolving the Legislative Assembly
- Giving assent, withholding assent, or reserving Bills for the President
These powers are expected to be exercised on the advice of the elected government, reinforcing democratic accountability.
2. Discretionary Powers – Constitutional Ambiguity
The Constitution grants limited discretionary powers to the Governor, primarily under Article 163. These include:
- Appointment of Chief Minister in a hung Assembly
- Reporting breakdown of constitutional machinery (Article 356)
- Reservation of Bills for Presidential consideration
Ambiguity in discretion has often been the root cause of conflict between the Governor and the State Legislative Assembly.
3. Authority of the State Legislative Assembly
The Legislative Assembly represents the direct mandate of the people. Its authority flows from democratic legitimacy and collective responsibility of the executive.
- Determines the survival of the government through confidence motions
- Controls public finance and budgetary approval
- Acts as the primary forum of accountability
4. Nature of Conflicts
Conflicts arise when Governors appear to act beyond constitutional conventions, such as:
- Delaying assent to Bills passed by the Assembly
- Interfering in floor test procedures
- Questioning the majority of an elected government
Such actions weaken trust in institutions and create governance paralysis.
5. Democratic & Federal Impact
When discretionary powers overshadow elected authority, federalism becomes distorted. The Assembly’s supremacy in a parliamentary system must be respected to preserve democratic balance.
