 1. Anti-Defection Law: A Constitutional Paradox

The Anti-Defection Law was introduced with a noble intention — to curb political opportunism and ensure stability of elected governments. However, its working has exposed a fundamental paradox: a law meant to strengthen democracy has often weakened democratic deliberation.

In a representative democracy, legislators are expected to voice the concerns of their constituents. The rigid application of party whips, backed by the threat of disqualification, has reduced legislators to mere numbers rather than representatives.

 3. Speaker’s Role & Institutional Morality

The Speaker occupies a high constitutional office and is expected to rise above party politics. However, the concentration of adjudicatory power under the Tenth Schedule has repeatedly tested institutional morality.

When constitutional authorities appear partisan, public faith in democratic institutions is seriously undermined.

 4. Judiciary as a Democratic Corrective

The judiciary has played a crucial role in restoring constitutional balance by subjecting the Speaker’s decisions to judicial review. Supreme Court interventions have reaffirmed that no constitutional authority is beyond accountability.

 5. Ethical Dimensions & Democratic Values

Beyond legality, the Anti-Defection Law raises important ethical questions:

  • Should loyalty to party override loyalty to voters?
  • Can stability justify silencing dissent?
  • Is procedural correctness enough without moral neutrality?

 6. Way Forward: Balancing Stability & Freedom

India’s democracy needs a rebalanced Anti-Defection framework that:

  • Protects government stability
  • Respects legislative freedom
  • Ensures neutrality of constitutional offices
  • Strengthens ethical political culture
